This English version is provided for convenience; in case of discrepancy, the French version prevails.
1. Purpose
These terms of use govern access to and use of the conciergerie.luxe website, an introduction service between owners of high-end properties for short-term rental and professional concierge companies.
2. An introduction service
conciergerie.luxe introduces the owner to the partner concierge for their area. The publisher acts exclusively as an intermediary: it performs no concierge services and is not a party to any contract concluded between the owner and the concierge.
3. Free of charge for the owner
Use of the service and the introduction are free and with no obligation for the owner. The service is paid for by the partner concierges, with which contracts are concluded and invoiced by Conciergerie des Saisons, a SARL (limited liability company) with share capital of €500, registered with the Lille Métropole Trade and Companies Register under number 101 034 361 (SIRET 101 034 361 00010), whose registered office is at 41 rue Jacquemars Giélée, 59800 Lille, France, represented by its manager, Dany Pain. However, the concierge’s services are chargeable: the quote it sends the owner may be free or chargeable according to its own terms, and its rates and terms are solely a matter for the concierge. The owner remains free to accept, negotiate or refuse any proposal.
4. Accuracy of information
The user undertakes to provide accurate information when making a request. Incorrect information may prevent a relevant introduction.
5. Response time and nature of the commitment
The publisher undertakes to look for a partner concierge in the owner’s area and to get back to the owner within 24 working hours (Monday to Friday, 9am to 12.30pm and 1.30pm to 5pm). This is an obligation of means, not of result: it is possible that no concierge will accept the request. In that case, the publisher informs the owner that the search was unsuccessful, without incurring any liability as a result.
6. Liability
The publisher acts as an intermediary. It guarantees neither an actual introduction, nor the conclusion of a contract, nor the quality of the services of the partner concierge, with which the owner contracts freely. The publisher cannot be held liable for the absence of an available concierge, nor for the performance or non-performance of concierge services. To the extent permitted by law, its liability may only be incurred in the event of proven fault and does not include indirect damage (loss of income, loss of opportunity or commercial loss). The publisher is not responsible for the acts, failures or services of the concierge, nor for disputes arising between the owner and the concierge.
7. Intellectual property
The website’s content is protected; see the legal notice.
8. Personal data
Data processing is described in the privacy policy.
9. Governing law
These terms of use are governed by French law. Any dispute falls within the jurisdiction of the competent courts, failing an amicable settlement.
